• GracesSkateCloset.com makes signing up easy and free. Simply click on
the Register Now Link
in the top right corner of the web page.
• You should now be on the registration page.Fill in the registration form.
You will need to select a Username/Password and you will need to provide an
e-mail address.
• Once you have filled in the required information and accepted the Privacy
Policy and User Agreement click the
Sign Me Up button.
• With in minutes you will receive an e-mail to verify your e-mail address.
• You will need to click on a link in the verification e-mail to
activate your account.
• Once you have completed the verification process you will receive an e-mail
confirming your account is setup and ready to go.

Find the perfect dress or skates – two ways:

1.You simply click on the size you want on
the menu to the left for dresses or skates. A new page will appear with a
selection of items currently listed. When you find something you are interested
in, simply click on the image you like to find more information.
2. Set up a “Listing Alert.”
• This requires GracesSkateCloset.com Registration
and that you sign in.
• Once you sign in click the Manage My
Account button.
• Now select which size(s) you are interested in on the listing alert
form and save your selections.
• An e-mail will be sent to you whenever a new listing meeting your criteria is
posted. Simply watch your e-mail for new listings.

• When you find an item you are interested in, you may want to try it on
and physically inspect the item before you make an offer. This might be
possible if the item is located near you and the seller has indicated on the
listing that they are willing to arrange a fitting. If this is the case,
you can click on the “Leave Contact Information” to alert the seller of your
interest. After leaving an e-mail address and/or phone number the seller will
then respond and arrange a meeting time and place (e.g. at the local ice rink,
a public place, business or residence). Who knows, you might even make a new
skate friend too.
• Not enough information on the listing? You may ask questions to the seller by
clicking on the ”Ask Seller a Question” button.
• As the buyer you will pay any shipping costs, in addition to the price you
offer. You should consider this before making an offer. Your shipping will be
specified in the listing. You will have the ability to calculate it by
submitting your mailing zip code and clicking the ”Check Shipping Cost” button.

| Making an Offer |

• Making an offer requires GracesSkateCloset.com registration
and that you sign in first.
• Once you are signed in you will be able to Make an offer on an item. You will
have to click on the item you are interested in. You will find a box to
enter an offer on the items detailed description page.
• To make an offer on the item, enter the price you are willing to pay and
push the “Make Offer” button. Your offer can be below, at or above the
asking price.
• It will then be up to the seller to accept or reject your offer. The
seller may accept or reject offers any time before the ad expires and up to 24
hours after the listing expiration date shown on the listing.
• If accepted, the seller will coordinate with you payment and
shipping/pickup details. Payment may be through Paypal, check or money
order, or even cash if picked up directly as specified in the ad by the seller.
Shipping costs are usually covered by the buyer in addition to the accepted
buying price.

refer to our User Agreement.
All items listed on the Grace’s Skate Closet web site must be related to ice
skating, primarily figure skating. Any item listed that is deemed inappropriate
in the eyes of Grace’s Skate Closet management or our users will be removed.
• Once you sign in, click the “Post Item For Sale” link on the left menu
to input your item details. This will include an Asking Price, size
details, a detailed description, item condition, shipment options, payment
options, item location, and fitting options. Upload photos (up to 6).
• You should preview your ad to make sure it looks the way you want and
all details are correct. Click the Preview Listing button to do this. Your ad
will appear in a new window. Make any needed changes in the original form and
preview again until you have everything just right.
• Use the Save Listing button to save your listing. You are not done
yet; you still need to publish it.
• If you have additional listings you want to create click on the Create
another Listing button (or start over from the main menu).
• Now that you are satisfied with your listing(s) you are ready to publish them
to GracesSkateCloset.com for others to view. Publishing means that you have
paid for the listing and it is now available for the world to see on
GracesSkateCloset.com.
• To Publish your ad(s) you must go to your Manage My Account page.
• You will find that you are now at a secure web site (notice the Lock symbol
at the bottom of your browser window). You will see a section listing your
“Items to be Published.” Here you will have options to preview, edit, delete,
and publish your unpublished listing(s). To Publish your listing, find and check
the listing(s) you want to publish and click the “Publish” button.
If you have a discount code, you will enter that here before selecting the
“Publish” button.
• The cost to post an Ad for 14 days is $3
per listing ($5
for a multiple identical item listing), which you will be asked to pay at
this point. Payment can be made by VISA, Master Card or American Express.

• Now that your ad is available to the world you will soon get offers,
questions, and fitting requests (if you stated that you were open to this in
your ad) for your item. These will come to you via the e-mail address you
provided. Respond to listing e-mails promptly. All Offers will be listed
on your Manage My Account page
when you are signed in (only visible by you).
• Note that potential buyers will not have your e-mail address; all requests,
questions and offers will flow through our site to avoid unwanted spammers from
getting your e-mail address. However, you will receive the e-mail address
and/or phone number of your item’s potential buyer when they contact you.
• With offers in hand it is now up to you accept or reject your offers. You
may accept offers anytime up to 24 hours after your listing expires. If you
have not accepted an offer when your listing expires, you will receive an
e-mail showing all offers and notifying you that the listing has expired. If
you have not accepted an offer within 24 hours after the listing expired, a
notice will automatically be sent rejecting all offers. You will have an option
to re-list your item at this time.
• Accepting an Offer: when you are ready to accept an offer, sign in
and go to the Manage My Account page. Select the offer you want to accept. Click
the “Accept” button. A note will appear with the offer details and an opportunity
to write the buyer a note. After completing the form, press the “Sell
Item” button to confirm acceptance of the offer. The buyer will receive
an e-mail from you confirming that their offer has been accepted with
instructions to complete the deal with your comments attached. All other offers
will automatically receive an e-mail notifying them that another offer was
accepted. Once payment is received, deliver the listed item to the buyer.
• Renewing your Listing:
In the event that you did not get an acceptable offer in the time your item was
listed, you may renew your add. Your listing will be moved to your pre-listing
section of your Manage My Account page 24 hours after expiration (if you
do not accept an offer). There you can republish the listing in the same manner
and for the same price as when you first published the listing.
• Withdrawing your Listing:
In the event you sell your item outside of GracesSkateCloset.com listings or
just change your mind about selling your item, you may withdraw your listing at
anytime. This feature is available on the Manage My Account page. Upon
withdrawing your listing, all offers will be sent an e-mail notifying them that
the listing has been withdrawn. There will be no refund of the listing fees.

• You simply click on the length of the music you want on the menu to
the left. A new page will appear with a selection of items currently listed.
The music is grouped in categories (i.e. classical, movie sound tracks, Disney,
etc.) to help speed up your search.
• You may preview the music by clicking on the music icon next to the
listings. You will need an audio player to do this, like: Realplayer, iTunes,
or Windows Media player. Note that the samples are a lower quality than the
originals being purchased and have a spoiler (beep every 15 seconds). The
purchased version will be of higher quality and the spoiler removed.

or American Express. Music cuts are vary in price and are set by the seller.
You will see a list of items you selected and a total cost for confirmation.

THIS IS A LEGAL AGREEMENT BETWEEN YOU AND GRACE’S SKATE CLOSET STATING THE
TERMS THAT GOVERN YOUR USE OF SOUND RECORDINGS (“Products”) PURCHASED ON THIS
SITE. THIS AGREEMENT - TOGETHER WITH ALL UPDATES, ADDITIONAL TERMS, USER
AGREEMENT, AND ALL OF GRACE’S SKATE CLOSET'S RULES AND POLICIES - COLLECTIVELY
CONSTITUTE THE "AGREEMENT" BETWEEN YOU AND GRACE’S SKATE CLOSET.
If you are under the age of 18, you should review these terms and conditions
with your parent or guardian to make sure that you and your parent or guardian
understand these terms and conditions.
You agree that your purchase of Products constitutes your acceptance of and
agreement to use such Products solely in accordance with the Usage Rules, and
that any other use of the Products may constitute a copyright infringement.
Grace’s Skate Closet reserves the right to modify the Usage Rules at any time.

collections, in part or in whole. Sound recordings may not be traded or
exploited for profit or any other reason.

constitutes acceptance of these terms.

• To post music for sell on GracesSkateCloset.com YOU MUST HAVE THE APPROPRIATE
MUSIC RIGHTS. Refer to the Music Rights Requirement below for more
details and refer to our User Agreement.
• Selling music requires GracesSkateCloset.com
registration and that you sign in first.
• Once you sign in, click the “Post Music” link to input your music details.
This will include the music length, category, format, and title.
• You need to upload the music and license information. You will also be
able to upload a unique graphic to represent your music. The music file must be
less than 5MB and be one of the following formats: .mp3 (preferred), .m3u,
.cda, .asx, .wm, .wma, .wmp, .wmx, and .wav.
• Use the “SAVE and UPLOAD” button to upload your files and listing
information.
• Once you finish filling in your item details and upload your music and
graphic, you will have an opportunity to preview your music listing before it
is published. You should preview your ad to make sure it looks the way you want
and all details are correct. Click the “View” button to do this. The ad will
appear in a new window. Make any needed changes with the “Edit” button and
preview again until you have everything just right. Be sure to save any changes
with the “Save and Upload” button.
• If you have additional music you want to sell, click on the “Clear To Add
Another” button.
• Now that you are satisfied with your music listing(s) you are ready to
publish them to GracesSkateCloset.com for others to view, demo, and buy.
• To publish your music click on the “Publish” button. The cost to post
music is $

for each listing, which you will be asked to pay at this point. Note
that music listings do not expire and no additional posting fee is required to
keep your music listed.
• You will find that you are now at a secure web site (notice the Lock symbol
at the bottom of your browser window). Payment can be made by VISA, Master Card
or American Express.

• Your music is available to the world and people will be previewing and buying
you music. If you choose, you may receive an e-mail whenever your music is
purchased (check this on the Manage My
Account page) or you may simply check the
Manage My Account page periodically to see how many times your music
has been purchased and how much you have earned. Note that you will have the
ability to edit your music listing from the
Manage My Account page.
• Your account will be credited half the list price every time your music is
purchased, without you doing anything but posting it on GracesSkateCloset.com.
• You may withdraw earnings from your account at any time by clicking
the “CASH OUT” button on your Manage My
Account page. The minimum withdrawal amount is $10. A confirmation
e-mail will be sent to you requiring a response from you to confirm the funds
request. Once confirmation is received a check will be sent to you for the
amount requested.
• Withdrawing your Music: You may remove your music from
GracesSkateCloset.com listings at anytime. This feature is available on the
Manage My Account page. Note that there will be no refund of the
original listing fees. You will still be able to withdraw any earnings you have
accrued.

GUARANTEE: You guarantee that you own and or control the copyright to
the recordings and the musical compositions or have acquired the appropriate
licenses, as may be necessary, for the recordings and the musical compositions
in each of the Represented Sound Recordings and has and will hold throughout
the Territory and during the Term the below listed rights to exploit the
Represented Tracks as contemplated herein. You agree to indemnify
GracesSkateCloset.com and to defend GracesSkateCloset.com against any copyright
infringement or licensing claims made by any entity or person who alleges that
you have violated their intellectual property rights due to your failure to
obtain the necessary permissions and licenses for the usage of any copyright
protected material that you incorporate into your music. Do not send us music
that violates the law. The Territory is the world and Term is the life of the
seller. As the Seller you grant the purchaser of your listed sound recording
the following terms of use: THE PURCHASER MAY:

Background Information:
It is common practice for competitive figure skaters to use music that has been
re-mixed from CDs or cassette tapes they have purchased (or purchased by their
coach).
The music used is often well known copyrighted music. The purchased music is
digitally remixed to fit a specified event length (e.g. 2.5 min, or 4 min,
etc.). The re-mixed piece may be a complete song, or various parts of a song or
a combination of several different songs compiled as a single piece. For
further reference I will call them “Skate Montages.”
Some skaters create their own Skate Montages from music they have purchased.
They buy the music themselves. They create the Skate Montage themselves,
editing and remixing their sound recordings. They copy it to tape or burn it to
a CD themselves. This is legal. Under fair use, they may make a copy for
personal use of their sound recording which makes this legal.
Most of the time, though, this re-mixing and recording is done by the coaches,
burned to CD/Tapes and sold to their athletes. As far as I know, no copyright
issues are even considered (this is based on conversions with several coaches
that cut music for their athletes). Obviously, this is a violation of copyright
law and illegal.
There are a few professional companies that re-mix music. Some claim to be
doing it legally, but when questioned, they become very defensive and
uncooperative. I fear many of these may be illegal as well.
Some argue that they are only “charging for their time used to look for and
edit the music, as well as their expenses such as buying CDs, tapes etc.“ and
are not selling the Skate Montage itself. This is not a valid argument. The
owner of copyrighted sound recordings cannot instruct another to copy their
sound recordings to create the Skate Montage on their behalf. This is illegal.
This could be legal if the owner of sound recordings has all the appropriate
licenses or owns the copyright to the sound recordings used. Purchase of music
from a typical music store does not give one these rights. Read about the case
against MP3.com setting a precedence for this type of case:

RIAA prosecutes hundreds of individuals every month for similar sound recording
copyright violations. It is simply a matter of time for them to get around to
those violating these laws in the figure skating world. The penalty for
copyright infringement is rather high, $250,000 per violation and up to 10
years in prison.

For the typical Skate Montage to be legal, written permission must be granted
by both the record company and the publisher of each song. Record companies are
unlikely to grant permission for such usage and if they did, the fee would be
very high and the same thing is true for publishers.
Another source of music is music in the Public Domain. Music in the Public
Domain does not require permission from the publisher (the composer). For
example, classical music (written before 1923) is in the public domain. That
means that the composition (but not the recording itself, where the recording
was created after 1923) is free to use without permission. However, the post
1923 sound recordings are still protected by copyright law. Permission is still
required from the recording company. Also, some arrangements of pre 1923 music
may well be subject to copyright.
As you can see, it is very difficult to find music with the required rights to
legally create and sell Skate Montages from popular music distributed by the
record companies. Famous music recorded after 1923, as recorded by the original
artist, can never be used without the proper licenses. Public Domain music
recordings owned by record companies may be just as hard to acquire the
required rights.
There is an alternative - Independent Artist
Independent Artists create Original music and Cover Songs of popular music. Any
artist can record their own version of a famous song as a Cover song, by
getting a HFA license. While not recorded by the original artist, this still
provides the ability to have recognizable pop/rock etc. music in the Skate
Montages. Independent Artists may also create Classical music from the Public
Domain Material.
Royalty free music libraries are another possible source of music. Individuals
with the rights to various sound recording libraries may make their music
available to skaters/coaches for the purpose of creating Skate Montages.
These less famous Independent Artist and owners of music libraries are willing
to grant the rights to use their music for the purpose intended by figure
skaters for a reasonable price plus royalties. Skate Montages created using
this music (with the appropriate rights granted) may be posted on Grace’s Skate
Closet for sale.
Some famous artists are very liberal with their music and may be approached
directly via their websites, particularly if they are promoting their latest
release. They may be able to obtain what is essentially a waiver of the normal
licensing rules for you. For example, The Who’s Pete Townsend has allowed
certain songs to be released for free on independent music sites. Other
examples of famous musicians who have tried to compel their labels and
publishers to relax the normally stringent rules include Tom Petty, Billy Idol,
The Offspring and David Bowie. If there is a famous song that you feel you must
have, try to contact the manager for the artist directly via the artist’s
personal website. You might be surprised to find out that you will be given
permission directly from the artist. As it becomes more and more difficult for
artists to earn a living due to the pressure of the marketplace, more and more
famous artists are looking for ways to promote their music and may be willing
to go to bat for you against the label and publisher. Explain clearly what your
intentions are and perhaps you will get a favorable response.
To make this process easier we have created a site for independent artists to
post music in which they provide the rights to use their music for the purpose
intended by figure skaters and coaches, as Skate Montages. This site is
www.GracesMusicSource.com . Now coaches can go to this site and
purchase music and the rights in which they can legal use to create Skate
Montages for resale. The coaches can then legally make income through sales to
their own skaters and they can make additional income by selling their Skate
Montages to other skaters through the Grace’s Skate Closet web site. Grace’s
Skate Closet has made it possible for coaches to eliminate the legal problems
associated with skate montages.
